County Of Martin issued the following announcement on Oct. 13.

PUBLIC HEARING NOTICE

Planning Commission/Board of Adjustment

October 25, 2022

The Martin County Planning Commission/Board of Adjustment will be conducting a public hearing on October 25, 2022 at 5:30 p.m.  The hearing will be held in the Martin County Commissioners Room, located on the first floor of the Courthouse, 201 Lake Avenue – Fairmont, MN.  The following items will be on the agenda:

Variance Request from Doug Peterson within Section 18 of East Chain Township. Mr. Peterson is proposing to construct a utility shed encroaching closer than the minimum required setback from the Rearyard setback and from the East Sideyard setback in an “SL-2” Residential Recreational District. The Martin County Zoning Ordinance requires a minimum setback of 50 feet from the Rearyard setback and a minimum setback of 30 feet from the Sideyard setback in an “SL-2” Residential Recreational District. 

Variance Request from Tanner Weihe within Section 20 of Westford Township. Mr. Weihe is proposing to construct a building addition onto an existing barn encroaching closer than the minimum required setback from the side yard setback in an “A” Agricultural District. The Martin County Zoning Ordinance requires a minimum setback of 30 feet from the side yard setback in an “A” Agricultural District. 

Variance Request (After-the-Fact) from Robert Poush within Section 7 of Silver Lake Township. Mr. Poush constructed a gazebo which is located closer than the minimum required setback to the ordinary high-water level of Wilmert Lake in an “SL-2” Residential Recreational District. The Martin County Zoning Ordinance requires a 150-foot setback from the ordinary high-water level in an “SL-2” Residential Recreational District.

Conditional Use Permit Request (After-the-Fact) from Tom Finke Excavating, LLC (Kurt Koehler, property owner) within Section 9 of Lake Belt Township.  Tom Finke Excavating has been operating a mining operation to extract sand in an “A” Agricultural District. The Martin County Zoning Ordinance requires a Conditional Use Permit in an “A” Agricultural District for any extraction of minerals. 

Any persons interested in this public hearing are urged to attend the Planning Commission/Board of Adjustment meeting.
